Description
Appellant Andrew Quinns convictions for first degree murder and second degree murder constituted double jeopardy. The sentencing court therefore properly vacated the "lesser" conviction for second degree murder. We also reject Quinns additional grounds for review. Accordingly, Quinns sentence for first degree murder is affirmed. A jury found Quinn guilty of both first degree murder and second degree felony murder after he shot and killed Jason Jack. Quinn filed a personal restraint petition, contending that both convictions for a single homicide violated the double jeopardy clauses of the state and federal constitutions. This court agreed and remanded the case with directions to vacate the felony murder conviction. In re Personal Restraint of Quinn, No. 43503-5-I, August 23, 1999.
